Terms and Conditions

www.aiescape.com, referred as the “Website” and ”Site” is operated by Archimedes Inspiration Ltd. Throughout the Site, the terms “we”, “us” and “our” refer to Archimedes Inspiration Ltd. Archimedes Inspiration Ltd. offers this Website, including all information, tools and services available from this Site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. Throughout the Site, the terms “you” and “your” refer to the user and all the persons for whom the booking is made or transferred.

By visiting our Site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available in our Privacy and Cookies Policy. These Terms of Service apply to all users of the Site, including but not limited to users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our Website. By accessing or using any part of the Site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the Website or use any Services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current Site shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our Website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the Website following the posting of any changes constitutes acceptance of those changes.

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

By making a booking, the first named person on the booking, herein referred as the “Lead Name”, agrees on behalf of all persons detailed on the booking that he/she:

  1. has read, understood and agreed to our terms and conditions
  2. confirms that he/she is over 16 years of age and where placing an order for services with age restrictions declares that he/she and all members of the party are of the appropriate age to purchase the services
  3. understand and accept to our use of information disclosed in our Privacy & Cookies Policy
  4. all information provided is true and correct, to the best of your knowledge and belief
  1. Please note that gift vouchers are valid for 2 years starting from the date of purchase. If a longer period is required, please contact us before the expiry date.
  2. Vouchers are only valid for a single transaction. Any remaining amount will not be exchangeable for cash or another voucher and will be automatically forfeited.
  3. Vouchers cannot be refunded or exchanged for cash so please keep them safe.
  4. In the event that a booking exceeds the value of the applied voucher, additional costs will be paid by the redeemer.

Players must be aged 16 or over at the time of the booking to book with us.

In order to participate in the activity, all children below 16 must be accompanied by a group of adults.

These Terms & Conditions and any agreement to which they apply are governed in all respects by the laws of England and Wales and each party agrees that any dispute, claim or other matter which arises out of or in connection with your contract or booking will be dealt with by the Courts of England and Wales only.

All special requests must be notified to us at the time of booking. Although we will do our best to accommodate any special requests, we regret we cannot promise that the requests will be complied with unless a written confirmation has been specifically sent to you. Failure to meet any special request will not be a breach of contract on our part unless the request has been confirmed. We do not accept bookings that are conditional upon any special request being met.

If you or any member of your party has any medical problem or disability which may affect the booking arrangements of that person, please contact us before you confirm your booking so we can advise you on the suitability of the chosen booking.

In such cases, you must provide us full details in writing at the time of the booking and we may require you to produce a doctor’s certificate certifying that the person(s) in question is fit to participate in the activity.

Acting reasonably, if we are unable to properly accommodate the needs of the person(s) concerned, we will not confirm your booking or if you did not give us full details at the time of booking, we will cancel it and impose applicable cancellation charges when we become aware of these details.

  1. The Lead Name must receive prior consent from all members of the party and ensure that they have read and agree to be bound by these terms and conditions.
  2. The Lead Name must be 16 years of age or over at the time of the booking and is responsible for all the following:
  • full payment of the provided products and/or services including any subsequent amendment or cancellation charges that may arise
  • acceptance and confirmation that all members of the party read and agree to be bound by these terms and conditions
  • provide all members of the party with full information in relation to the booking, including any consequent changes.
  1. A booking is made when:
  • you accept our quote based on your selected services and/or products

AND

  • you check-out and pay the quote

AND

  • we issue you with a booking confirmation to the provided email in the booking
  1. When a booking confirmation is issued, a contract between you and us will exist that will confirm the details of your booking
  2. If you believe that any of the details provided in the booking confirmation is wrong, it is your responsibility to contact and notify us immediately. Failure to do so, may result in the loss of your rights.

Archimedes Inspiration Ltd. uses a 3rd party payment platform, www.stripe.com “Stripe” to process payments and charges. We do not store or host any debit or credit card information on our Site and do not have access to such information. By making a booking you authorise Stripe to charge you through your provided form of payment and you will be responsible for charges of any products or services ordered through our Site. If Stripe does not receive payment from your credit card issuer, or other payment mechanism that you use, you agree to pay all amounts due hereunder upon request and will be solely responsible for any dispute with your payment provider. Should the credit card or other payment mechanism provided be declined for insufficient funds or for any other reason, you will be solely responsible for all overdraft fees and/or penalties that may be assessed by your payment provider. All use of Stripe is subject to the terms and conditions applicable thereto and available at www.stripe.com.

In addition, Archimedes Inspiration Ltd. uses a 3rd party booking platform, resova.com “Resova” to accept bookings online. All use of Resova is subject to the terms and conditions applicable thereto and available at resova.com

  1. We want all of our visitors to enjoy their experience and we would like to remind you that access to our premises are subject to these terms:
  • we may ask for proof of booking before giving you access to the rooms
  • visitors under the age of 16 shall be allowed only if accompanied by at least one adult at all times. In such cases, the Lead Name will be responsible for the welfare of all members of their group who are aged under 16.
  • we reserve the right to refuse admission to or to require to leave the premises to (without providing a refund) anyone:

– where there might be a risk to your safety or the safety of others if we do not do so

– who behaves in an antisocial way and/or appears to be intoxicated.

– who is smoking inside the premises

  1. To not spoil the enjoyment of others, please arrive on time. We reserve the right to delay or refuse the admittance of latecomers.
  2. We shall not be liable for refusal of access of latecomers and a refund will not be made. However, entirely at our discretion, we may offer a reschedule in specific circumstances.
  1. Changes by us
  • Prices for our products and services are subject to change without notice.
  • We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
  • We will do our best to meet all your requirements that are under our control. However, whenever necessary, we reserve the right to make modifications to and correct errors to the event details before and after your booking has been confirmed.
  • If we need to make major changes or cancel your booking, you will be offered alternative booking arrangements or a full refund of all monies paid.
  • For changes made by us, you must notify us your choice within 7 days of our offer. If you fail to do so we will assume that you have chosen to accept the change or alternative booking arrangements.
  • All changes to your booking made by us will be notified to you as soon as possible.
  • We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
  • In exceptional circumstances, we may be forced by “Force Majeure” to change or terminate your arrangements. If this occurs, we regret that we will be unable to make any refunds, pay you compensation or meet any costs or expenses you incur as a result.
  1. Changes by you
  • Any changes made to the booking after it has been made must be informed to us in writing as soon as possible.
  • Amendments must be requested from the email used during the booking.
  • We shall do our best to meet your requirements but cannot guarantee that all modifications will be met.
  • Where we can meet a request, we may charge you an administration fee of £35 per change and any applicable rate changes or extra costs incurred by us and/or imposed by any of our suppliers.
  • Where we are unable to assist you and you do not wish to proceed with the original booking we will treat this as a cancellation by you and a cancellation fee may be payable.
  • No refunds will be given for bookings that are cancelled.
  • If you wish to re-arrange your booking and re-schedule your time slot, you must notify us in writing 3 days before the date of your booked game. We will rearrange your booking wherever possible but cannot guarantee it.
  • Changes requested with 24-72 hours advanced notice from the start of your booking will be charged a £35 handling fee
  • Changes requested with 24 hours advance notice from the start of your booking will be charged 50% of the total booking for the last minute change
  • In the case that a reschedule requested by you cannot be met, we reserve the right to cancel your booking without a refund
  • No refund or rescheduling is available for no-shows
  1. Please note, we cannot accept any liability and will not be responsible or pay you any compensation for any damage, injury, illness, death, loss, cost, expense or any other sum or claim of any type which results from any of the following:
  • the act(s) and/or omissions(s) of you and/or another member of your party

OR

  • the act(s) and/or omission(s) of a third party not connected with the provision of the services contracted for and which were unforeseeable or unavoidable

OR

  • unusual and unforeseeable circumstances beyond our or our supplier(s) control, the consequences of which could not have been avoided even if all due care had been exercised (including, without limitation, the circumstances outlined in the section entitled “Force Majeure” below)

OR

  • an event which we or the supplier of services, even with all due care, could not foresee or forestall
  1. We are not responsible for any accidents which:
  • occur in Archimedes Inspiration buildings due to your inappropriate or irresponsible behaviour
  • any accidents which occur anywhere on properties because of any items or property which you have broken and/or have left in a way in which injury can result.
  1. For the avoidance of doubt, nothing in this agreement shall limit or exclude our liability for death or personal injury resulting from our negligence, for fraud or fraudulent misrepresentation or for any other liability the exclusion or limitation of which is not permitted by English law.

We hope all our visitors have a good time and in addition to our admission terms, we would like to remind you that you are responsible for:

  1. your safety, actions and the effect they may have on others
  2. the condition of the property you occupy and the damages you may cause to them
  3. your own timekeeping. If you arrive after your scheduled booking time we reserve the right to cancel your booking without providing any refund

Except where otherwise specified in these terms and conditions, we will not accept liability or pay any compensation where the performance of our contractual obligations is affected by reason of circumstances amounting to “Force Majeure”. In these terms and conditions “Force Majeure” means any event which we or the supplier of the services in question could not, even with all due care, foresee or avoid. Such events including and not be limited to war or threat of war, riots, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather condition, fire and similar impediments which are beyond our reasonable control may constitute Force Majeure.
